Terms of Service

These Terms of Service ("Terms") govern your use of the Wyro Events website and application at wyroevents.com ("Service"), operated by Wyro Events ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Wyro Events is an event planning and management platform that allows users to create events, manage guest lists, send invitations, collect RSVPs, and coordinate event details. The Service is currently provided free of charge. We reserve the right to introduce paid features or plans in the future, with reasonable notice.

2. Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information.
  • Keep your login credentials secure and confidential.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload, share, or transmit any content that is defamatory, obscene, abusive, threatening, or that infringes the rights of others.
  • Attempt to gain unauthorised access to the Service, other accounts, or any related systems.
  • Use the Service to send spam, unsolicited communications, or bulk messages unrelated to genuine event management.
  • Interfere with or disrupt the Service or its infrastructure.
  • Scrape, harvest, or collect information from the Service by automated means without our consent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4. Your Content

You retain ownership of any content you create, upload, or share through the Service ("Your Content"), including event details, guest lists, images, and messages.

By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing and improving the Service. We will not use Your Content for any other purpose without your consent.

You are responsible for ensuring that Your Content does not infringe the rights of any third party and complies with all applicable laws.

5. Guest Information

As an event organiser, you may collect personal information from your guests through the Service (e.g., names, email addresses, dietary requirements, RSVP responses). You acknowledge that:

  • You are responsible for obtaining any necessary consent from your guests before collecting their information.
  • You will handle guest information in accordance with applicable privacy laws, including the Australian Privacy Act 1988 (Cth).
  • We process guest information on your behalf to provide the Service, as described in our Privacy Policy.

6. Intellectual Property

The Service, including its design, code, branding, logos, and documentation, is owned by Wyro Events and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by Australian Consumer Law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Wyro Events, its owner, and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill arising out of or in connection with your use of the Service.

Where liability cannot be excluded under Australian Consumer Law, our total liability to you for any claim is limited to the amount you have paid us for the Service in the 12 months preceding the claim (or, if the Service is free, AUD $100).

9. Indemnification

You agree to indemnify and hold harmless Wyro Events, its owner, and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any content you create, upload, or share through the Service.

10. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
